GST Annual Return

All registered suppliers of goods and services have to file timely returns.

The GST Annual Return statement is to be filed annually every registered person other than:

  1. An Input Service Distributor
  2. A person deducting tax at source
  3. A person collecting tax at source
  4. A casual taxable person
  5. A non-resident taxable person
  6. A department of Central/ State government (or Local Authority) whose books are subject to audit by CA & AG (or Local Authority auditor)

The annual return is filed in Form GSTR-9 whereas a person paying tax under the composition scheme is required to file annual return in Form GSTR-9A.

Turnover based applicability

In order to give relief to small tax payers, the Central government notified on 9th October 2019 that filing of annual return will be optional for registered persons whose aggregate turnover in a financial year does not exceed Rs. 2 crores. This limit now stands at Rs 5 crores as per decision taken at the GST council meeting dated 14th March 2020. The new limit is applicable from FY 2018-19 onwards.

GST Audit

Every registered person whose turnover during the financial year 2018-19 exceeds Rs. 5 crores needs to get their accounts audited by a chartered accountant or a cost accountant.


The person who gets their accounts audited is required to furnish a copy of audited annual accounts and a reconciliation statement in Form GSTR-9C.

Types of forms

Form Details
GSTR-9 All registered persons (other than composition suppliers and electronic commerce operators required to collect TCS) required to file annual return shall use this form.
GSTR-9A Composition suppliers required to file annual return shall file this form.
GSTR-9B Electronic Commerce Operators who are required to collect tax at source shall file this form
GSTR-9C This form is a reconciliation statement and is to be filed by all registered persons who are required to get their accounts audited.

Time limit for annual return

The annual return must be filed by a registered person on or before 31st December of the next financial year. So far, the due dates of filing annual returns for the first two financial years i.e. FY 2017-18 and FY 2018-19 have been repeatedly extended. As per the current position, the due date for filing annual return is as follows: -

7th February, 2020: Uttar Pradesh, Madhya Pradesh, Manipur, Mizoram, Tripura, Bihar, Sikkim, Arunachal Pradesh, Nagaland, Meghalaya, Assam, West Bengal, Andaman & Nicobar Islands, Odisha, Jharkhand, Chhattisgarh, Dadra & Nagar Haveli, Daman & Diu, Lakshadweep.

Late fee for delayed filing

The late fee for delayed filing of GSTR-9 is Rs. 100 per day per Act (CGST Act and SGST Act) subject to a maximum of 0.25% of turnover in the relevant state/ union territory.


However, the GST Council in its 39th meeting decided that registered suppliers with an aggregate annual turnover of less than Rs. 2 crores in FY 2017-18 and FY 2018-19 will not have to pay any late fee for delayed filing of GSTR-9.

What is the due date for filing GST Annual Return for FY 2018-19?

The GST council in their 39th meeting on 14th March 2020 extended the due date for annual return for FY 2018-19 to 30th June 2020.

Who is required to get accounts audited under GST?

For the financial year 2018-19, registered taxpayers whose turnover exceeds Rs. 5 crores shall get their accounts audited by a chartered accountant or a cost accountant. For the Financial year 2017-18 (1st July 2017 to 31st March 2018), audit was applicable if aggregate turnover exceeded Rs. 2 crores.

What is aggregate turnover?

Aggregate turnover means, aggregate value of (i) all taxable supplies (excluding inward supplies under reverse charge), (ii) exempt supplies, (iii) export of goods or services or both and (iv) inter-state supplies; of the person having the same Permanent Account Number (PAN), to be computed on all-India basis. Aggregate turnover shall exclude any tax, cess, etc.

I have cancelled my registration before the end of the financial year. Do I need to file annual return?

Yes. Annual return must be filed if the supplier was registered during any part of the financial year.

Can Annual Return be revised?

No. So far there is no provision/ rule in the GST law that allows revision of annual return.

Who can file NIL return in GSTR-9?

“NIL” GSTR-9 RETURN can be filed if, during the financial year, the following conditions are satisfied:

  1. No sale
  2. No purchase of goods/ services
  3. No liability of any kind
  4. No claim of any Credit during the Financial Year
  5. No receipt of order creating demand
  6. No claim of any refund
